Quick Facts about Kansas's Gambling and Poker Views

Individual Online Gamblers

Kansas qualifies as a state that is very anti-gambling, but they approach it from a direction of wanting to stop the operators of the game, instead of going after the individual gamblers. We will get more into what they are doing to stop the operators in the next section, but there are still a fair number of laws that concern those individual gamblers in the state. The state of Kansas makes it illegal to make a bet on anything. They define bet as risking anything of value on anything pertaining to chance. While this is a fairly standard definition it shows that they want to make sure they can include pretty much everything under that definition. Also, the laws in the state allow them to seize anything that could be considered a gambling device, and that includes standard fair of chips, tables, etc, but also includes electronic devices. This is a fairly broad and wide-ranging definition.

Despite being a more conservative state with a very fundamental governor there haven’t been any real movements on going after online gamblers. The state has yet to prosecute anyone for playing online poker and that is unlikely to change right now as the state is facing many issues that just don’t make it worth it. Players should be very comfortable continuing to play as a result of this and shouldn’t worry about it very much, especially as there are no specific laws on the books about online poker.

Online Poker Operators

This is the mechanism that Kansas tries to use most heavily to thwart online and live gamblers. This approach is likely more fair to the individuals of the state, as just playing in the games will not result in harsh penalties for you. That being said, it does create an unfortunate situation for those who try to host games in the state. Speaking by the letter of the law social games are not allowed and the penalties for hosting such games can be rather severe. He same goes for any kind of commercial enterprise that might be running illegally in the state. Kansas hasn’t went after any of the online sites though, so it isn’t completely clear how online sites fit into the overall case law of the state, at least at this point.

How do Offshore Gambling Sites view Kansas?

This state is large and so pretty much it would not be prudent of the off shore sites to ignore the state. While there are no direct laws against online gambling, it is still viewed in a negative light, luckily, the legal system has been fairly unwilling to go after online sites. Kansas has far too many advantages to really ignore with a fairly well off population base, a large community of players that clearly like poker, but may not have easy access to it and a non-aggressive legal system which has not really put online sites to the test. Players from Kansas shouldn’t worry about the major sites leaving anytime soon as they have stayed this long as the state hasn’t changed its laws recently and so there doesn’t appear to be a desire to root out offshore sites, and federal regulations have been toned down significantly in terms of interpretation and enforcement. All of the major US-facing sites are available to Kansas citizens to play on whether you want poker, sports betting or casino.

Regulation Chances

Kansas is one of the states would be helped immensely by the legalization of poker and other gambling, but is likely far too conservative to actually do it. The population of Kansas is fairly well off economically, but there are major budget shortfalls, especially in education and other public programs. Without a clamoring for higher taxes, especially with a republican governor, gambling could help solve those issues without offending the large conservative political base. Of course, that would be if the governor of the state wasn’t exceptional conservative Christian and would have his ideals best described by the doctrine of the group “Family Values.” As a result, there is a very slim chance that any movement is made on gambling in the state while the current power structure of the state still exists. Once that power structure changes though, something will need to happen for the state

Land Based Gambling

Kansas has slowly been getting more open to the idea of gambling in recent years and this is clearly seen by the expansion of commercial casinos in the state, especially in the eastern half of the state. With the rise of commercial casinos it gives an otherwise fairly conservative state with limited gambling options an above average amount of options available to their citizens. The state also enjoy a state lottery, pari-mutual betting and a limited about of charitable gambling. There are no tribal casinos in the state and there were no commercial casinos until recently either.

While none of the traditional powers are present in the state, in terms of commercial casinos, there are still very large casino companies in the state that could either pay for good software or enter into some kind of agreement with a bigger company to offer regulated online gambling if that were to become a thing in the state of Kansas. We are obviously still not to that point, but at least seeing a direction for them to take opens the door for that kind of thing to happen.
