(2) entering or remaining in a gambling place with intent to make a bet, to participate in a lottery or to play a gambling device.
(b) Gambling is a class B nonperson misdemeanor.

In order to get more clarity on whether or not online poker is covered under this statute, we must turn to the definitions contained in 21-6403. It's here that we find out what the state considers a bet:

(a) “Bet” means a bargain in which the parties agree that, dependent upon chance, one stands to win or lose something of value specified in the agreement.

There follows a lengthy list of things that do not fall under the classification of a bet, including legitimate business transactions, contests of skill, and the various state-regulated types of gambling. The phrase “dependent upon chance” along with the carveout for contests of skill seems to leave open an avenue for poker to be classified as a non-gambling game. The State of Kansas applies the Dominant Factor Test, which attempts to discern whether chance or skill predominates in a given game to determine whether it counts as gambling. In 2013, the journal of the University of Chicago Law School published a paper from a team including noted economist Steven Levitt that concluded that poker easily contains enough skill to be deemed a non-gambling pursuit under the Dominant Factor Test.

However, the way this law has been actually interpreted in the Sunflower State, poker is viewed by the authorities as a game of chance. In the Three Kings Holdings case, a Kansas appellate court uphold a lower court's ruling that a variation of Texas Hold'em, called Kandu Challenge, was a form of non-legal gambling. This game actually had elements added to make it more of a game of skill than normal Hold'em, so we can conclude that regular poker is even more likely to be viewed as a luck-based endeavor in the eyes of the law. Now, this isn't an ironclad ruling, and other jurisdictions have decided in favor of poker being a game of skill, like federal judge Jack B. Weinstein did in 2012. There is therefore the possibility that Kansas judges will reverse this opinion in the future, but as of right now, they consider poker to be illegal under the law.

This doesn't address poker played specifically in the online arena at all, and so this is a bit of a gray area. In 1996, the attorney general of the state issued an opinion that the existing anti-gambling laws applied to internet gaming as well, but this theory has never been tested in court. In fact, nobody has ever been charged within Kansas for playing poker online. The odds of any laws being used to go after you, a private internet poker player, are virtually nil. So you don't have to worry about the penalties of the class B misdemeanor charge of gambling, which are up to six months in prison and/or a fine of up to $1,000.

Those who actually manage illicit gambling operations within the state might indeed be subject to these penalties. There are additional crimes that they could be found guilty of, including illegal bingo operation, commercial gambling, dealing in gambling devices, unlawful possession of a gambling device, and installing communication facilities for gamblers. These are a mixture of misdemeanors and felonies, and the toughest of these laws are felonies of severity level 8, the sentences for which are variable and depend upon a lot of factors encapsulated in a complex grid system. Fines can reach as high as $100,000, and the standard term of imprisonment is eight months although repeat offenders can see their prison time increase. Prosecutors don't have a history of going after offshore companies, though, mostly confining their efforts to organizations that have a physical presence in the state. The counsels retained by the leading internet poker sites have undoubtedly advised their clients that the possibility of their being found to be in violation of the Kansas gambling laws is slim indeed. Although there was some commerce through Kansas during the early 19th century via the Santa Fe and Oregon trails, it was only after the Civil War that the population started to boom. The spread of the railroad and the opening of the Chisholm Trail for cattle drives both increased Kansas' economic importance. Cowtowns like Abilene, Wichita, and Ellsworth soon appeared. The most famous (or infamous) of these towns was Dodge City. There was poker, faro, chuck-a-luck, and Spanish Monte to separate the recently paid cowboys from their cash not to mention alcohol and prostitution.

The Long Branch Saloon was the most elegant of these establishments with a five-piece orchestra providing music. The building itself was built as the result of a wager. Cowboys and soldiers had squared off against each other in a ball game with the proviso that if the soldiers lost, they would provide building materials for a saloon, and this is just what happened.

Through the doors of the Long Branch passed a veritable who's who of Wild West lore: Wyatt Earp, Bat Masterson, Doc Holliday, and Luke Short (part-owner of the Long Branch) to name a few. Of course, the combination of guns, booze, and gambling led to quite a few violent disputes over the years, including a fatal gunfight in 1879.

Alas, once more respectable, civic-minded people moved in, it was only a matter of time before most of the saloons and gambling dens were closed beginning in the 1880s. In 1895, Kansas lawmakers made gambling, setting up a gambling table, and keeping a place for betting on cards illegal. A few years later, slot machines were explicitly prohibited. Lotteries had already been banned by the Kansas Constitution.

It took a long time thereafter until any form of real money gaming was allowed, but in 1974, bingo was permitted to charitable groups. In 1986, dog and horse racing was authorized but only for nonprofits. However, in the following year pari-mutuel betting became available on a wider basis, regulated by the Kansas Racing Commission. A few racing tracks soon opened up, but the last one closed its doors in 2008, and there are now no places for wagering on either horse or dog races within The Wheat State.

In 1987, the Kansas Lottery was created.
